Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Dram Tales mobile applications, website, and related services (collectively, the "Service"). The Service is operated by Sodam Labs LLC, doing business as "Dram Tales" ("Sodam Labs", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be of legal drinking age to use the Service. In the United States, you must be at least 21 years old. If you reside outside the United States, you must be at least the legal drinking age in your jurisdiction. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for adults of legal drinking age and is not directed to minors.

2. Your Account

To use most features you must create an account. You agree to provide accurate information and to keep it current. 3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Post content that is false, misleading, defamatory, harassing, hateful, or infringing;
• Promote excessive, underage, or unsafe alcohol consumption, or the sale of alcohol in violation of law;
• Attempt to access accounts or data that are not yours, or interfere with or disrupt the Service;
• Use bots, scrapers, or other automated means to access the Service without our permission.

4. Your Content

The Service lets you create and share content, including reviews ("Tales"), tasting notes, ratings, photos, and collection details ("Your Content"). You retain ownership of Your Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content for the purpose of operating, providing, and promoting the Service. You are responsible for Your Content and represent that you have the rights necessary to share it.

5. Responsible Drinking

Dram Tales is a platform for enthusiasts to catalog and discuss whiskey and other spirits. We do not sell alcohol, and nothing in the Service is an offer to sell or a solicitation to purchase alcohol. We do not encourage excessive or irresponsible consumption. Please drink responsibly and in accordance with the laws of your jurisdiction.

6. Intellectual Property

The Service, including its design, text, graphics, logos, and software, is owned by Sodam Labs or its licensors and is protected by intellectual property laws. Except for Your Content and as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any information available through the Service (including bottle data and user reviews) is accurate or complete.

8. Limitation of Liability

To the maximum extent permitted by law, Sodam Labs and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Illinois will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, to the extent permitted by law.
